At issue on this appeal is the constitutionality of Illinois interspousal tort immunity statute. The district court, on a motion for summary judgment, rejected the constitutional challenge to the statute and dismissed those portions of Deborah Morans suit against her husband in which she alleged that he had beaten her. We reverse.
